Overview

Kent County is authorized by the state of Delaware to promulgate and enforce the rules regulating construction. Del. Code Ann. tit. 16, § 7601 (promulgation of building codes). The county of Kent, Del. adopted the following ICC codes:

Residential Building Code

Delaware has yet to adopt a statewide residential code. Local laws will control.See PLRB, Delaware Building Codes for more information on state level codes.

Kent County adopted the 2012 IRC, locally. Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.

Kent County hereby adopts the International Residential Code/2012, with all referenced codes including Appendix C, Exit terminals of mechanical draft and direct vent venting systems; Appendix G, Swimming pools, spas and saunas; Appendix J, Existing buildings and structures; Appendix M, Home day care – R-3 occupancy; Appendix R, Manufactured Housing Code; and the Kent County Supplement to be the standard to which residential structures are constructed. Copies of the supplement are available in the Department of Planning Services – Division of Inspections and Enforcement.

Kent County Building Code Supplements.

  • According to Table R301.2(1), Ice barriers are not required.
  • Section R313 was deleted in its entirety. Automatic fire sprinklers are not required.

Existing Buildings

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

Appendix J of the IRC was adopted, the regulations found under that appendix would apply to existing residential buildings.

Commercial Building Code

Kent County adopted the 2012 IBC, statewide with limitations. Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.
