Liability Session I
Premises Liability Session
I covers the fundamentals of premises liability law. Session I begins with an overview and workshop which give the
student an opportunity to work through several real life hypothetical scenarios. Session I then continues with discussion of
the duties property owners and occupiers owe to entrants including invitees,
licensees, and trespassers. Session I
is the prerequisite for Session II.
After
completing the course, the student will be able to describe the majority and
minority views for classifying entrants to property. Students will be able to distinguish between invitees, licensees,
and trespassers. Students will be able
to identify when status of an entrant can change and thus change the duty owed
by the owner or occupier of the land.
Students will be able to apply the benefit of the owner test in
distinguishing between licensees and invitees where appropriate. Finally, students will be able to describe
the duty owed to an entrant by the owner or occupier of land based on the
classification of the entrant. The
course is designed for students in the area of first-party property insurance
coverage and litigation.
