Torts in Cyberspace: Coverage Issues

While the Internet provides nearly unlimited access to new and useful information, it can also be used as a platform for defaming, slandering, and bullying. Often when there is a tort a casualty insurance claim is filed.

One of the Casualty Campus sessions at the 2016 Claims Conference will be "Torts in Cyberspace: Coverage Issues," presented by Rina Carmel, JD, Attorney, Zelle McDonough & Cohen, LLP, Los Angeles, California, and Paul Healy, Senior Examiner, Liberty Mutual Insurance, Boston, Massachusetts.

At the conclusion of the session, attendees will be able to:

  • Define the unique elements of cybertorts, including cyberdefamation, cyberbullying, and cyberstalking;
  • Compare methods of properly investigating cybertort claims and traditional tort claims;
  • Evaluate coverage under CGL, Homeowners, and excess/umbrella policies for cybertorts; and
  • Analyze whether the new ISO 2014 endorsements, which exclude coverage for access or disclosure of personal or confidential information and data liability, bar coverage.

The 2016 Claims Conference features continuing education for casualty adjusters with sessions facilitated by insurance professionals. Two dozen casualty campus sessions are available out of the 100 sessions offered for the continued professional development of both property and casualty adjusters.

The Property & Liability Resource Bureau 2016 Claims Conference will be held April 17 to 20 at the Henry B. Gonzalez Convention Center in San Antonio. Registration is open to property and casualty insurance professionals who work for or represent insurance companies.

The 2016 Insurance Services Expo will be held Monday, April 18 and Tuesday, April 19 in the Henry B. Gonzalez Convention Center. Nearly 300 exhibitors will exhibit with products and services to assist insurers in providing claims services to policyholders.

The Expo showcases skilled national and regional providers of casualty adjustment services, such as legal firms and legal billing review firms. Attendees are invited to enjoy a complimentary lunch with the exhibitors in the Expo hall on both Monday and Tuesday of the conference. They will have an opportunity to enhance their professional development by connecting with a large network of subject matter experts and industry partners during the lunch break.
