Emerging Right of Privacy Claims

Consumer privacy is all the rage. From junk faxes to texts, to data breaches, to recording conversations, to the security of customer databases, every business must be keenly aware of the potential for lawsuits based on the twin desires to be left alone and to have information kept a secret. Insurance carriers, especially liability insurers, are hardly immune from claims involving violations of people's privacy. These claims, indeed, often implicate the Privacy Offense in commercial general liability policies, and provoke spirited coverage disputes.

The Property & Liability Resource Bureau's recent webinar, "Emerging Right of Privacy Claims," will help answer what insurance carriers are doing to mitigate this exposure. The presenter is Jonathan Schwartz, JD, partner, Goldberg Segalla. He explored the types of consumer privacy claims that businesses face, which claims for coverage insurers can expect to confront, and what steps insurers are taking to limit their exposure to these claims. He also offered strategies and insights on how to analyze and respond to these consumer privacy claims.

Viewers of the recorded webinar will learn to:

  • Evaluate emerging "violation of right of privacy" claims created by policyholders to trigger CGL coverage;
  • Determine whether these claims satisfy the CGL policy's violation of the right of privacy offense; and
  • Identify various potentially applicable CGL policy exclusions.
